Suggestions, complaints and appeals

SUGGESTIONS & COMPLAINTS

Any institution or individual wishing to present a formal complaint, offer suggestions or launch an appeal relating to ACCUEE’s operating practices may do so either in person or online using the Suggestions and Complaints section on the electronic headquarters of the Gobierno de Canarias. It will then be forwarded to the competent body for processing, which shall depend on the subject matter in question. In our case, those dealing with ACCUEE’s operating practices. A formal response must be returned within 3 months. In the event you feel that you have received an inadequate response, you may take the matter to the General Directorate for the Modernization and Quality Assurance of Services Delivered by the Canary Islands Regional Government (Dirección General de Modernización y Calidad de los Servicios del Gobierno de Canarias).

LEGISLATION

Law 39/2015, dated 1 october, on Public Administrations & Common Administrative Procedures. (LPAC).
Decree 161/2002, dated 18 november, approving the Regulation of the Suggestions and Complaints System for the Public Administration of the Autonomous Community of the Canary Islands, which modifies Decree 220/2000, dated 4 December, Regulating the List of Services, Quality Assurance Assessment Systems & Annual Awards for the Quality of Public Services and Best Practice in the Public Administration of the Autonomous Community of the Canary Islands.
Ministerial Order dated 20 February, 2004, that expounds the Suggestions and Complaints System for the Public Administration of the Autonomous Community of the Canary Islands.
 

APPEALS

Official administrative channels will be exhausted following the decisions of the Governing Board and the resolutions or acts of the Agency’s Directorate, in their respective areas of competence. These decisions may be disputed by lodging an appeal for reconsideration or through administrative litigation in the Contentious-Administrative Jurisdiction (Jurisdicción Contencioso-Administrativa). In the case of appeals relating to assessment results, these appeals will be received and processed internally by ACCUEE staff, after which a report is issued by the corresponding assessment committee.

Decree 250/2017. dated 26 december, on Regulations Governing the Organisational Structure and Functions of the Canarian Agency for Quality Assessment and Accreditation in Higher Education. The appeal system for administrative acts and resolutions offered by the Agency is detailed in Art.19.

GUARANTEE COMMISSION

For the procedures of ex ante accreditation (implementation and verification), modification, monitoring and ex post accreditation of study programmes, and in accordance with the Criteria and Guidelines for Quality Assurance in the European Higher Education Area (ESG), the direction of the ACCUEE has created a technical committee of experts called the Guarantee Commission. The function of this committee is to analyse and issue reports on possible appeals and complaints submitted by universities regarding the decisions adopted in the different university quality assurance processes in which the ACCUEE participates, and which are directly related to the compliance with the ESG.
